Case overview

In August 2020, Swancor Company discovered counterfeit resin products of our company's trademark in Zaoqiang County, Hebei Province. Our company immediately organized anti-counterfeiting personnel to go to the local area for investigation. After the arduous investigation by our anti-counterfeiting personnel and the investigation and evidence collection of the local market supervision and administration bureau, as well as the cooperation of the Baotou Market Supervision and Administration Bureau, the criminal clues of Chen Moumou were finally transferred to the public security authorities. The court found that Chen Moumou, the actual controller of a certain fiber limited liability company in Baotou, purchased 50 barrels of resin from a certain chemical technology company in Shanghai and affixed counterfeit SWANCOR trademarks on these 50 barrels of resin. In February 2023, After investigation by the Public Security Bureau of Zaoqiang County, public prosecution by the People's Procuratorate of Zaoqiang County, and judgment by the People's Court of Zaoqiang County, Chen Moumou was convicted of counterfeiting registered trademarks and sentenced to one year and six months in prison, suspended for two years, and fined 10,000 yuan.

After receiving the criminal judgment, Swancor Company immediately initiated a civil infringement lawsuit. In April 2024, the Taocu District People's Court of Hengshui City lawfully ruled that Chen Moumou should compensate Swancor Company a total of 71,052 yuan for various losses and expenses.

Seeking meager profits, committing crimes and losing money

What is worth pondering in this case is that Chen Moumou, as an industry insider, took a desperate risk for illegal profits. In the end, he was not only sentenced to fixed-term imprisonment but also had to bear a huge economic compensation, which can be said to be a case of not being worth it. Here, Swancor Company also warns all merchants who attempt to sell products by counterfeiting trademarks, confusing trademarks, or riding on famous brands, etc., not to obtain illegal profits through illegal means.
